Terms of Service

These terms apply to every project and monthly service Devfinity provides, unless a written agreement for a specific project says otherwise. By accepting a quote you agree to them. Please also read our Refund & Cancellation Policy.

1. Quotes and scope

Each project is quoted against a written scope listing what is included. A quote is valid for 30 days unless it states otherwise. Work outside the agreed scope — extra pages, features, revision rounds or platforms — is quoted separately and done only after you approve it.

2. Payment

• Projects are normally paid in stages: a deposit before work begins, and the remaining balance in instalments tied to the milestones in your quote.
• Monthly services are billed in advance for each month.
• Invoices are due on the date stated on them. We may pause work while an invoice is overdue.
• Prices are in Pakistani rupees unless your quote states another currency.

3. Third-party costs

Domains, hosting, premium themes or plugins, software licences, app store developer accounts, payment gateway fees and advertising budgets are paid by you directly to those providers, or reimbursed to us where we pay on your behalf with your approval. They are not part of our fee, and the providers' own terms apply to them.

4. Your responsibilities

• Provide content, feedback, approvals and access on time. Project timelines depend on it, and delays on your side move the timeline.
• Make sure you have the right to use any text, images, logos or other material you supply, and that it is lawful.
• Review each stage when it is delivered. Approval of a stage means work proceeds on that basis.

5. Revisions

Each quote states the number of revision rounds included. A revision round is one consolidated set of changes to delivered work. Additional rounds, or changes to work you have already approved, may be charged.

6. Ownership and intellectual property

When you have paid in full, ownership of the final deliverables we create for you — designs, code written specifically for your project, and content — passes to you. Until then, we retain it. Third-party components (open-source libraries, licensed fonts, themes, stock media) remain under their own licences. We may keep general know-how, reusable tools and code that is not specific to your project.

Accounts we set up for you — domain, hosting, analytics, social and ad accounts — are registered in your name wherever the provider allows.

7. Portfolio

We may show completed work in our portfolio unless you ask us not to in writing. We never publish confidential information.

8. Monthly services

Social media management, advertising management, SEO and website care run month to month. Either party may end a monthly service by giving written notice (WhatsApp counts) before the next billing month; the current paid month runs to its end.

9. No guarantees of results

We guarantee to carry out the agreed work with reasonable skill and care. We do not guarantee search rankings, follower counts, ad performance, sales or other outcomes that depend on platforms, markets and factors outside our control.

10. Liability

To the extent permitted by law, our total liability for any claim relating to a project is limited to the fees you paid us for that project (or, for a monthly service, the fees paid in the three months before the claim). We are not liable for indirect losses such as lost profit or business interruption, or for failures of third-party platforms and providers.

11. Acceptable use

We do not build or promote content that is unlawful or harmful. Our Acceptable Use Policy sets out what we will not work on.

12. Governing law

These terms are governed by the laws of Pakistan, and disputes are subject to the jurisdiction of the courts of Pakistan. We will always try to resolve a disagreement by talking first.

13. Changes

We may update these terms. The version in force when you accept a quote applies to that project.
